Still trying to get my deposit back

Lived at Bristol Pointe for two years and it was great the floor plans are hugh and the money was right. King Landing bought them and fired the security guard and never replaced him but instead installed security alarms at a price to the residents. The pool was so crowded from people jumping the fence that did not live there on the weekend they were even throwing furniture in the pool.Of course the security guard that they never replaced was always the one that constantly patroled the swimming pool asking for everyones pass for the pool to make sure you were a resident. I moved due to major price increase and now I have been fighting for my deposit that King Landing owes me for over five months.

Did you receive a statement regarding any charges toward your deposit? By law they have 30 days to refund your security deposit and send you a statement with an itemized list of charges that was deducted from your deposit. (Must be post marked no later than the 30th day). As long as you did not skip out, gave a thirty day written notice and your rent was paid in full. They can not charge for normal wear and tear. They also cannot pad the charges, they have to be reasonable and you can ask to see any and all invoices for repairs. After the 30 day deadline, you can file a small claim in the local Justice of the Peace Office (cost about $60 to $90)and if the Judge determaines they acted in bad faith, you can receive 3 times the amount of your deposit plus attorney fees. Paragraph 42 of you Texas Apartment Association Lease contract explains deposit refund. Section 92.109 of the Texas Red Book (Landlord/Tenant Laws) explains Liability of The Landlord. This section sets out the penalties for the owner who in bad faith ratains a security deposit. Hope this helps, good luck. There are alot of people complaining about King Landing.

I had to file a case in small claims court after fighting to get my deposit back for 8 months. As soon as they were served, I received my check. Unfortunately, they didn't seem to respond to anything else. Also, I filed a complaint with the Better Business Bureau. It did no good, but perhaps it will help people in the future know not to rent here. Good luck.
