Evictions' Lock-Outs' Poor Bookkeeping' Unethical Practices' It's all here!

Years at this apartment: 2007 - 2008
Pt 1 I m still residing in River Ridge apartments as of 7/9/2008. I'm catching hell! I have always paid my rent on time, and most times it's early. I've taken my proof of rent paid to the rent office several times since May 2008 showing them that I've satisfied my rent on time. Every time I received a notice (all unnecessarily), I went to the office immediately to resolve the misunderstanding. On each occasion I would speak with either office representative, ("T" slim or Tu), and they would continually tell me that everything is worked out, they are not sure what happen, they made a mistake, or everything is fine. "T" advised me on 2 different occasions Mr. Jackson I m working on you new lease right now, and I ll have it for you today, only for me to come home to a notice to vacate on the door and/or a locked door.
I received notices to vacate and/or lock out notices on the following dates: 7/7, 6/19, locked out on 6/26, notice to lockout on 6/23, 6/11, and 5/14. The staff locked me out and took my laptop computer from my apartment. They are refusing to release it.
After I was locked out on June 26, I called to have my apartment unlocked. The facilities/maintenance person tried to swindle me out of some money illegally saying: I ll unlock your apartment, but you must give me a $400 money order first. The next day the office personnel "T" was asked by a paralegal assistant and I, if that that is the order of the company that the facilities/maintenance personnel would collect any funds before unlocking a tenants doors' Toni said, facilities/maintenance people are not to ever ask for money for the office. I later asked the facilities/maintenance person about his claim of needing $400. He said, I m doing what I was told. I was told to collect half of what is due. I told him he s lying, I told him I already talked to the office personnel and she said no that s not right. He said, Oh well, I don t know what to say. I don t know what s going on. I filed a police report. The detective advised me what I could consider doing next.
Pt 2 I met and talked with the new manager "M" Monday July 7, 2008. Per her request, I faxed proof (canceled checks front/back for April rent $456, May rent $539 and June rent $539.) on 7/7/08 @ 8:39pm. The office just cashed my July rent check July 7th for $540. "M" probably never received my proof as her assistants may have withheld it from her. I still expect "M" to contact me after her investigation to the claim that I have late rent for June $117.35, I owe late fees for June s rent $100 and that I missed July s rent $535
I never received a notice to renew or pay month to month. Hopefully she will address these issues as well. I've continually asked for a copy of my lease and my notice to renew my lease as recent as 7/7, and no one has ever been able to provide me either.
I signed a 13 month lease, and I thought I would have the option to renew before Ashley Village automatically increased my rent substantially making me pay month to month without any prior notice.
The apartment dwelling is okay. The staff is a totally different story. I've lived here since April 2007 under a 13 month lease. I moved from a large 1bdrm into 1bdrm efficiency Oct 2007 where I was to complete my lease. When the River Ridge office shut down and the new management office (Ashley Village) took over, lots of unfair, unexplainable, unethical behavior started happening and continues to this day.
All of this could have totally avoided if 2 things would have happen:
1) If there was better communication amongst the office personnel and from the office over all, and if the staff kept good records of the payments that I made in April (April 1/April 17(May rent)) and every month after that including July s checked cashed on 7/7, and
2) If the office personnel would simply given me a renewal notice that I should have received the end of April. Even though they lost my records during the transition, they still could have done the decent thing and talked with me so we can get the proper understanding and proceed forward without all this confusion.
Future tenants, learn the law. Know your rights regarding lock-outs, evictions, and removal of your personal property whether you are leasing apartments and/or buying a house. By all means, find you a real estate lawyer. Good legal advise and/or possible retention should you need legal representation is a must (especially if you plan on leasing with Ashley Village/River Ridge apartments.) Remember when dealing with companies; always contact your local Better Business Bureau.
Check back later, I will keep you abreast of any/all resolution regarding this matter.
I ll post some additional information on this site regarding some specific illegal unethical activity that some of the staff members are currently engaging in following this entry.
