Trash Heap
An apartment complex featured in a recent 7 On Your Side report is back in the limelight. This time trash concerns at The Park at Walnut Creek are the center of attention.
Tenants say weeks of complaining to the complex got them nowhere.
Earlier this month, neighbors were concerned about a heaping pile of trash at the compactor. The pile was on the parking lot next to several tenant buildings.
"It was very disgusting," tenant Thadeus Keating said.
Keating was sick of it.
"Plenty of flies everywhere," Keating said. "Not happy. Just very disappointed in the complex."
7 On Your Side also received several e-mails about the trash pile.
"They claim that they have a porter to pick it up and that it gets like that on the weekends, but there's no excuse for it," tenant Kyle Thomas said. "It feels like I live in a dump. We're overpaying."
The city of Austin's Solid Waste Division also received complaints.
"I've never seen a complex like that that had such an accumulation of trash," said Steve Ramirez, a code enforcement manager for the Solid Waste Division.
The city responded by filing charges against the apartment complex. Municipal court ordered the complex to remove the trash. When it wasn't removed the city picked-up 120 cubic yards of trash from complex.
The complex will have to pay for the city-assisted clean-up and the apartment ownership faces up to a two thousand dollar a day fine if the trash starts piling up again.
"Our ultimate effort is to get the owner, of course, to keep the property cleaned-up on their own, but if we have to do it, we'll do it and keep the legal charges going as well," Ramirez said.
We left numerous messages with the apartment's ownership in Louisiana and did not receive a call back.
It's not the first time 7 On Your Side has received complaints about The Park at Walnut Creek. In March, a tenant complained about a persistent leak in her apartment. After our calls to the complex, the leak was eventually repaired.
But tenants say the quality of life has gone downhill at The Park at Walnut Creek ever since MBS Properties took over last year.
"I've just grown fed up with them," Thomas said.
"I'd just rather be somewhere else," Keating said. "Somewhere more convenient."
The Austin-Travis County Health Department visited the site before the clean-up and found a violation of the health and safety code. That means the complex will be continually monitored by the health department and fined if there are any violations.
