Poor Maintenance, Poor Management

The place needs to be painted, there are rat problems, ant problems. Maintenance takes forever to get to your request, sometimes you have to put in your request two and three times. When you ask about it, you get a different story everytime. They are also renting to anyone with a pulse, so the quality of tenants has gone down. Fights break out at the pool and the police are here about every weekend. Keep looking, you can find a nicer place, for less money easy... All these positive reviews you keep seeing....Are the apartment managers writing them. BEWARE.

You know I'm not in the management industry but I can totally agree with this review. The staff can sometimes be rude and one particular employee by the name of ----- is a smart-ass. This complex nickles and dimes you on everything. All the apartments don't come with cieling fans, no microwaves, the damn stove doesn't even have a timer on it! The carpet is just god awful. Within less that week of moving into San Paloma we noticed our carpet was VERY VERY VERY DIRTY! Put it this way, if you walk barefoot on the carpet for say 20 minutes your feet will soon turn black from all the dirt and who knows what else. We asked the front office to please clean the carpet, as we did not dirty it, and your good old employee in the front, -----, was a smart-ass about it saying we called too late. So in a nutshell...DON'T MOVE INTO SAN PALOMA!

You're an idiot, she treated me well the ENTIRE time I lived there. Always smiling, always helpful, and always nice. Maybe it's because I was more her age, who knows. All I know is that is not an accurate description of her character. Oh and Paetra is definitely hot! One of the things I actually miss most about San Paloma is the staff, they were all cool to me. You idiots need to try being polite and you might actually get some good results from it.

The part of the review that talks about San Paloma charging late fees after the 2nd is true and the management could get in trouble with the state of TX. I just called the Austin Tenant Council at 512 474 1961 and they stated that it was against the TX state law for a landlord to charge any tenant late fees before the 5th. She said if your rent is due on the 2nd, late fees should be assessed on the 5th because the 5th is after the second day after the rent is due. I have attached a copy of Section 92.019 of the Texas Propety Code that states this.
Sec. 92.019.A LATE PAYMENT OF RENT; FEES.A (a)AAA landlord
may not charge a tenant a late fee for failing to pay rent unless:(1)AAnotice of the fee is included in a written lease;(2)AAthe fee is a reasonable estimate of uncertain
damages to the landlord that are incapable of precise calculation and result from late payment of rent; and(3)AAthe rent remains unpaid after the second day after the date the rent was originally due. (b)AAA late fee under this section may include an initial fee and a daily fee for each day the rent continues to remain unpaid.(c)AAA landlord who violates this section is liable to the tenant for an amount equal to the sum of $100, three times the amount of the late fee charged in violation of this section, and the tenant ??????s reasonable attorney ??????s fees.(d)AAA provision of a lease that purports to waive a right or exempt a party from a liability or duty under this section is void.(e)AAThis section relates only to a fee, charge, or other sum of money required to be paid under the lease if rent is not paid as provided by Subsection (a)(3), and does not affect the landlord ??????s right to terminate the lease or take other action permitted by the lease or other law.AAPayment of the fee, charge, or other sum of money by a tenant does not waive the right or remedies provided by this section.

I'm actually the guy who wrote the honest review at the top, the verbage I was quoting was not from AAA, it was from legistlation that just passed in Texas. It states that it is mandatory for the property owner to give a 3 day grace period making all rents due the 3rd at midnight. My company had originally had all late fees due the 3rd at 5 O'clock, we had to change it to the 3rd at midnight after the legistlature passed that amendment. And yes San Paloma could get in trouble, the tenants who have been charged late fees from that point could come together with a class action lawsuit against San Paloma in which they would be due all late fees charged plus damages. San Paloma obviously is not keeping up with the latest legistlative news which could get them in trouble. I cannot sue them as I have not ever been charged a late fee, but for those of you who have......There's some info for ya. :)

To the person above who said funny how they missed number 3: you should re-read #3 and this time try to COMPREHEND and UNDERSTAND what you read because YOU are the one who missed it. Funny isnt it? Anyway, #3 is the MAIN SEGMENT of the clause and that is the segment that tells you San Paloma is BREAKING THE TEXAS LAW! Let me break it down for you since you cant read. The TX Property Code says, A landlord cannot charge you late fees UNLESS (#3) the rent remains unpaid after the second day after the date the rent was originally due. Let me tell you how that applies to San Paloma. Our rent is due on the 2nd of the month. The second day after the date the rent is originally due is the 4th of the month. This means the 5th of the month is the day that they can legally charge late fees. San Paloma is allowed to charge late fees because the amount of the late fee charge is in the lease agreement which is #1 of the segment above. However, they are not allowed to charge late fees until the 5th of the month. However, one person above just stated that the law was recently changed to late fees only being assessed on the 4th of the month (on the third after midnight). Which means San Paloma is in violation of the NEW and OLD law. Therefore, all the residents who have been charged late fees with San Paloma can sue the HELL OUT OF SAN PALOMA! Call the Austin Tenant Council at 512-474-1961 and they will tell you!

The law states that rent is to be late after the second day that it is originally due. Therefore if it is due on the first and late "AFTER" the second there is no law being broken! Seems like the property you work for only hired you to show apartments and not to actually learn the lease.
