WE OWE OVER $1,000. Collection agency called 4 months after we left...no notice at all

This was the 5th place I've ever rented and the only one that has ever tried to charge for damages after move out. When we looked at the Overlook one of the girls was honest and told us that they will nickel and dime you after move out. We should have listened!!!! They are charging almost $1,000 for carpet replacement, $75 for trash which we absolutely did not leave behind, and $15 for the stove drip pans (metal bowls under the burner). I moved out of there at the end of June 2008 and and in November I get a call out the blue from a collections agency, OVER 4 MONTHS LATER!!! Apparently when I gave them my forwarding address upon move out they were not intelligent enough (or I should say careful enough, with the emphasis being on care because I don't think anyone there can legitimately say they care about the people that live there or that they do a decent job) to record my apartment number when they put my address in their computer. So...according to them they sent notices already, but when the mail got returned they were not intelligent enough or didn't care to pick up the phone and call me or my roomate whom lives in another property that they own now. They even sent 1 waterbill which we paid to his new address proving that they could have easily contacted us again, knowing perfectly well where he lives, with this 'overdue payment' notice. They are now saying that we didn't pay that waterbill. I have been in contact with the overlook about this situation for a week (since i got the call) and was told by the assistant manager (Meicy) that they would work with us and that she called the collections agency and told them to hold off. I guess she finally actually looked into it and said that they can't work with us and that we will have to deal with the collections agency. I asked to speak to her manager who she said was there at the time and was put on hold for several minutes and then basically told 'no, she won't speak with you, you will have to deal with the collections agency. I said to her, 'so you lied to me when you told me that you did already call the collections agency'' and she wouldn't say yes and insisted that she did call them. I did notice when we lived there that we constantly saw carpet being replaced around the complex....so it does sound like they try to do this to people as often as possible. Prior to this situation....our time there was a pain in the you know what. Evertime we needed something, we constantly had to go to the office to remind them and finally when they did get around to fixing things they half a**ed the job. We had to have our refrigerator replaced because it was leaking all over the floor. When they finally brought the 'new' one (used from another apartment i think, it was old and dinged up more than the first one) it leaked too!! On top of that they scratched up the floor in the kitchen when they replaced it. When they replaced the second fridge, the door wouldn't shut correctly, not allowing the door to seal (and costing us more in electric bills with the cold air leaking out). They attempted to fix the door...but gave up I guess and we were unable to get them to actually fix it before we moved out. All 3 windows in my bedroom would not lock because they wouldn't line up right. We tried to get them to fix this for the last 3 months or so when we lived there to no avail. I thought about getting a lawyer then and terminating the lease because of this safety issue...but figured it wasn't worth it because we were moving out soon. I had a painting hanging over the fireplace that fell down all of the sudden. The reason was because the wall had become all soggy and wet from a leak through the chimney. They fixed this by painting over the markings on the wall the water had caused. Now 4 months after move out...we owe them over $1,000 all of the sudden. These people are the definition of bad apartment management. Cindy (the apt manager while we lived there) was nice and helpful the few times we were actually able to speak with her directly....but it still took continuos follow up on our part to get things done or half a** done. Oh...and my brand new truck got keyed twice while I lived there...probably by the little hoodlums that run around the parking lots jumping on your cars (yes we actually so them running and jumping off random cars and reported to the management). IF YOU LIVE HERE MAKE SURE YOU GET EVERYTHING IN WRITING AND INSIST ON DOING A WALKTHROUGH WITH THE MANAGEMENT WHEN YOU LEAVE EVEN THOUGH THEY TELL YOU IT IS NOT NECESSARY. TAKE PICTURES OF THE PLACE WHEN YOU LEAVE. IF YOU HAVE ANY SENSE AT ALL, DO NOT MOVE HERE!!!!! Please respond to this post or make your own if you have been charge inaccurately after move out. WORST EXPRIENCE RENTING BY MILES!!!

I still currently live here, and have for the past five years. Numerous times I have THOUGHT of moving out, but I'm just staying here because I'm afraid to move out. I have heard NUMEROUS stories about charges after the fact....I'll just continue to live in my broken down apartment until I can afford a house or an attorney....I don't make enough money to move out....isn't that just ridiculous? Thank you so much for sharing your story...and I'm so sorry for all of your frustrations. Maybe with enough complaints we can do something...Can you report apartment complexes to the Better Business Beaureu? Just a thought...

In response to the person who has lived their for 5 years....you may be in the clear to move out of there for the carpet at least. If you have lived in the same apartment for 5 years than technically the carpet is worthless, according to the overlook the carpet is expected to last 5 years. The total for our carpet was almost $1,200. It was replaced just before we moved in so they divide that amount by 5 years (12 months) and then multiply that amount by the 13.5 months we lived their. If your carpet has already lasted 5 years, they should not be able to charge you anything if they have to replace it. I would get that in writing before you move out...but you should be good unless they try to pull something. Good luck and reply to let me know if they try to say otherwise. CYA as much as possible!! Well as I live here too this is very disconcerting as this isn't the first time I've heard of this happening to someone since I've lived here. I'd suggest the following, 1) obtain a copy of your file from the complex (they failed to give me a copy of my lease and other info when I moved in... most complexes give you a copy of your lease(s) I guess that's an overlook at Overlook. HA HA not really...) So you have the same info they do such as your "move-in inspection". 2) Upon moving out CYA, document everything I'd even take pictures of the apartment when you move out, make sure the date and time is on the photos when printed. I'd also replace those items such as stove drip pans as well as air filter and scrub the apartment from top to bottom. I don't recommend cleaning the carpet there is another review here where they claimed water damage and mold to the carpet because the departing renter had the carpets cleaned prior to moving out. I'd do some general spot cleaning and a good vacuuming. 3) should you have any issues educate yourself with the laws regarding apartments, landlords etc. and the http://www.taa.org/renterinfo/ is a good site to do this at. 4) write letters and send copies of those letters to everyone, the property, the headquarters in Dallas, Houston and Kansas City, the better business bureau and file your complaint with the Texas Apartment Association (www.taa.org). At least this is what I would and probably will do.

I currently live at Overlook and am rounding out my third year here. I absolutely hate moving. This place goes through employees like I change my underwear. I taks an act of congress to get any one of the multiple things repaired here. Literally, it takes on average of 3 maitenance requests to get anything done. Unless you like having to babysit the people who manage your apartment then DO NOT move in here.
