Beautiful property that needs serious updating

I am now in my new apartment, 2 weeks after the fact, and just received my deposit disposition.

First off, the balance forward is incorrect. I wrote a $1,000 check for half of a month at a rent rate of $879. Divide $879 by 2 = $439.50, which leaves $560.50 that should be the forwarding credit.

I left a brand new window air conditioning unit in the bedroom(which I am sure the maintenance men appreciated, 'cause it works great), and an entertainment center in each bedroom. There was also a box in my bedroom, 2 planters and a box of brand new sectional carpet I thought someone might like on the patio. I was charged $150 for the removal of these items - in addition to the $85 cleaning job. This is outrageous to me.

$359 for replacement of carpet. This carpet, according to the management, was replaced in May of 2003, making it 4 years old with a 5 year life. The damage to 2 areas was done by my idiot cat, for whom I paid a $400 deposit. $200 of this deposit is, by contract, non-refundable - however; OAG has an opinion on deposits. The term "non-refundable deposit" is a self-defeating term in that a deposit is refundable or able to be applied to other related costs as needed. The management disregarded the non-refundable portion when calculating my disposition.

If you are considering moving here, consider the eagerness to which the management is bound to retaining any and all of your deposit, as well as ensure you have a balance left over to pay.

I am now seeking counsil to resolve the matter. Class action seems to be best, if I can locate previous tenants for such a suit.

I've always found the management staff to be curteous (except ---, I don't know her that well and have only seen her once). The maintenence is very responsive, even came out to my apartment at 11 pm when someone shot a pellet through my slider.

As a fair and balanced person, I can honestly say that the problems in this place are not due to poor management staff, they are due to either a poor management company or a penny pinching owner.

Every one of these units has single paned windows that are very inefficient. Couple that with the foundation problems, and you have very little protection from outside weather because it comes right through the cracks. In addition, I believe the wiring is faulty, how else would I have a bill for $532 in a month when I was gone for two weeks with the air set to 65 and everything else but the fridge turned off' Since August, I have paid from $350 to $550 in electric. It is because the central air and heat suck in more outside air than it cools or heats.

I will, however, note that there are roof problems (aside from no insulation in the attic) that are simply patched from the inside and not fixed. I found that out during the recent rains when all the old patches in the ceiling began leaking.

I think, if you move here, you should move to a small middle unit only... under no circumstances rent the corner unit - as beautiful as it is, it's a rip off.

Other notes: The only assigned parking is the parking that is paid for monthly. I can hardly ever find a place to park that is near my building.

Yes, this complex has issues. I have lived here for 2.5 years. I have asked for maintenance 3 times during that time. Only one service call was actually satisfactory. This place is very inefficient. I lived in building 4 for 1 year, and then moved to building 1 for the last 18 months. Both buildings have single paned windows which desperatly need updating. During the winter it is almost like no windows at all because the drafts in the apartment are so severe. I have asked the management to weather proof the apartment twice, and both times I was told that the unit was as weather tight as it could be. I disagree; with multiple electric bills in excess of $500.00 and still wearing sweats and wrapped in a heavy quilt to stay warm during the winter. I have felt that something was wrong with the heater. This is in part to the extreme cost of using it, and the loud noise that my breaker box makes when the heater is in use. Twice the maintenance staff supposedly looked at the unit and everything checked out fine. After one week of use this month, the unit shorted out the breaker, partially melted the breaker, slightly scorched the wall, and filled my entire apartment with that wonderful charged electrical wiring smell. It was a very cold night that night. The management here does change frequently, and so does the remainder of the staff. I think this may be a training property for the property management company. The complex has many different issues which could and perhaps should be addressed here. Unfortunately I don't have time to discuss each one. However, this could indeed be a great property with just some minor upgrades, better management, etc. Unfortunately though, I woudl currently have to say this is a poor property. I have spoken with several people in my building. Two of them are indeed ineterested in joining a class action law suit. That is my main reason for responding to this email. Hopefully more people will step forth, and we can all recoup some of the funds that this property as bilked us for. Extreme electric bills due to poor maintenance, faulty units, mismanagement of deposits, etc. should all be combined in a single class action suit against the complex and management company. If I see some interest here on this site for such a suit, I will establish a website that we can all communicate through and connect. We can then take the matter to some legal eagles and get something done. I will check this site weekly.
