Good Price, but beware of the contract!!!!

I got a good deal on my 2/2 with garage. They also threw in one month free as well as a prorated 2 weeks free. Not bad for a seven month lease!

There have been problems though. Since moving in, our alarm system has broken, dishwasher has broken, microwave has broken, fire dectector fell from from ceiling, the tubs did not drain properly, plugs in guest bathroom failed to work, and the vent above the utility closet has fallen. This all occurred in our three months here. Stewart Creek has fixed most of them, but as soon as they fix one thing something else breaks!

Now my biggest gripe is their contract. I didn't realize this until 2 months into our lease, but Stewart Creek is not a part of TAA (Texas Apartment Association). So when we bought a home before the Katrina slaughtered the cost of local homes, we found that Stewart Creek was going to rake us over the coals to do so. Normally, under Texas law that is in a TAA contract, the release of contract is about 50/50 in favor of the resident and apartment. Since Stewart creek writes their own contracts, there is no favor towards the resident and the cost is about 45% of your entire contract! Are total cost for 7 months is $5845, to get out of the contract even just one day early would cost us more than $2600!!!

So if your job relocates you or a family emergency forces you to move, tough luck! They wrote their contract and you are stuck! Proceed with caution!

Actually as a resident who lived in a TAA apartment lease before Stewart Creek's lease is less strict. It states you must pay a reletting fee of 1 month of the market rent, you lose all deposits and you must pay back any specials you have used. A TAA lease you pay the same reletting fee, you lose your deposits and you must pay out the remainder of your lease unless you find someone willing to take over your lease. So actually they are nicer. I have lived here a year and I have had no major problems with my apartment. But for the minor things I have had wrong they came out there the same day. If you know you might get a job transfer and have to break your lease always ask questions and never sign a lease you have not read. This is common sense and you should not get mad at the office for your lack of reading or asking questions. I suggest also you get a copy of TAA lease and compare it. You would owe alot more.

Yeah.. I agree with jshelby on this one. I was in a TAA lease once and it was awful. The apartment complex I used to live in was in a TAA lease and there is no way out unless you want to pay every single month that you are not going to be living there which is a complete waste of money. I agree, read the lease before signing it and if you don't like it, go ahead to a TAA lease, I really don't think you would like that any better.
