Tuscany Villas

 

In one other post - so bad it is turning into a lawsuit....wonder how it ended' Let me tell you.

Tuscany Villas was served small claims papers for $4900.

I was suing them for my rent money back, deposits, move costs, etc.

Subsequently, they filed a countersuit (which I was never served on) for $4000 for my 19 days rent in August plus all the rent concessions back.

BRING IT ON!

I moved out August 19, 2006.

Court was so backed up that it got pushed out to May 2007.

I was patient.

Hadn't heard a word from them in all that time.

Yet on Friday, May 5 their attorney called me and asked if I wanted to settle.

Obviously they figured they couldn't win or you wouldn't settle.

I told them I wanted my $600 deposits back, plus $400 for my movers.

I signed their release form and within 5 days had my money.

They got nothing.

The key is DOCUMENT EVERYTHING.

Like another post said to call them - bad idea.

The law and your lease states that it has to be in writing.

They have 7 days to rectify the problem.

After 7 days you have to write another letter requesting repairs.

If they don't rectify it you can send a letter stating that you will be moving if repairs are not made withing x number of days - you choose the amount of time you want to give them.

They've already breached the contract.

I gave them another 14 days to no resolve.

I moved, sued, won.

Good for you! I'm so sick of these big companies walking all over people just because they know most people don't have the money to go to court.
