I am just going to submit our vacating letter.
September 18, 2002
Dear Brookridge Apartments,
Elizabeth and I regret to inform you that we will be vacating our apartment on October 31, 2002. The reason for our departure is due to several incidents that we have had within this community and the poor management of this facility. On numerous occasions we have had our dogs attacked by other residents dogs, but thankfully enough none of the attacks have resulted in injury. Fortunately enough nothing has happened yet, but it is just a matter of time. As a result of these incidents Betsy is terrified to even walk our dogs around this community for one of these times these incidents are going to get out of control. Residents in this community do not understand that their dogs are aggressive, and potentially dangerous, and with their lack of control over these animals bad things are bound to happen. I personally worry about the safety of my dogs, but my main concern is for the safety of Betsy, because I know that she will try to intervene in one of these attacks. Some of these aggressive dogs weigh over 100 pounds, and if one of these dogs turns on her for getting in the way she could be injured or killed very easily. I don?t know if this problem has anything to do with your policies, but I feel that we have no other choice, but to leave this community.
Second issue, is the poor management of this community. Several times during our short tenure here we have had major appliances fail on us. While this is understandable, what isn?t is that we were with out any source of clothes dryer for upwards of three weeks. This is unacceptable considering it took Betsy asking the management over 4 times to have problem fixed, and you continued to drop the ball. In addition to this problem, it took the management over 1 week to respond to our request to fix our hot water heater. So for one week, Betsy and myself had to take ice cold showers. And the last, but not least of our problems with the management of this facility is the fact that three times I have asked management to take care of the serious ant problem around our building. This problem is leading to large amounts of ants entering my residence, and getting into my food. We pay a large amount of money each month, not to have these problems.
We are giving you the courtesy of 45 days notice that we will be vacating this property, so that you can prepare. In addition I have spoken to my legal adviser, and he has told me that due to the incidents listed above we are more than in our right to brake this lease. Because the termination of this lease is due to the risk of safety to my family, and the inefficiency of the management staff here, we will not be giving one months rent as a penalty. If this is going to be a problem with your staff please note that we are more than happy to bring this matter before the court system to have it resolved. So before your staff acts on this matter, please think of the incidents above in making your decision. I hope that we can settle this matter without involving attorneys or wasting both of our time, in court. The last month of rent you will receive will be in October. If there is any questions regarding this matter please contact us at xxx-xxx-xxxx
Sincerely,
Mark Thomas
