6 months cost me over $13k!

All you have to do is check out their superior court cases in snohomish county. WHATEVER YOU DO - DO NOT SIGN a SETTLEMENT AGREEMENT TO MAKE PAYMENTS IF YOU FALL BEHIND ON A MONTH RENT - either to AVOID an unlawful detainer eviction on your credit or just cause you can't afford to move - TRUST ME - MOVE IMMEDIATELY!. I moved in Sept. and in November walking home from 7-11 I was swiped by a car turning a croner which hit all my bags and I didn't realize until 3 hours later that the 2 $500 money orders I had gotten at 7-11 got swept out in the traffic. I was only able to make a $500 payment and had to pay $24 in trace fees and wait 3 months to get my money back. As soon as I saw a barely legible summons posted on my door that I had 5 days in writing to contact the landlord and if I didn't could get a default judgment against me, I called her. That same day she and I agreed to a settlement that because they HAD NOT ACTUALLY FILED the Summons and Complaint (thus hurting my credit) and they were willing to take payments (I was renting a 2be for $985 and living by myself and was hardly in town a dream renter).

Anyway, I signed a settlement agreement that WAS ALTERED (if your really curious please email me at jelle@turich.com) several times after I signed it that consisted of $500 a week payments through March 1, to include all past rent, current, late and attorney fees, totally $3440.00. They insisted on money orders, could not after 15 emails and faxes give me a listing of payments (they kept altering the paperwork and what they were saying I owed and had paid) until I finally sat down on 2/25 and gathered all my reciepts to veirfy it before March 1 and realized that I only had $115 left to pay. So I got another money order and dropped it with a letter before they opened on 2/26. When I got back that afternoon I found a handwritten note on my door stating that their attorney stated stated I would need to pay $1200 before 9am the next morning or she would file the eviction. I wrote them they were mistaken and that I didn't know what ANOTHER $1200 was going to cover and it sure felt like a extortion threat tactic. BTW I have my JD in law I just don't practice law.

I panicked and called the courts and asked if they had any filing with my name on them and found out that; the landlord FILED a DIFFERENT SUMMONS AND COMPLAINT 10 DAYS AFTER WE SIGNED AND ENTERED INTO THE SETTLMENT AGREEMENT THE ATTORNEY DRAFTED AND HAD NOT NOTIFIED THE COURT OF THE AGREEMENTS OR PAYMENTS OF $3500 I had paid to them. (which was something else they dropped on me, one of the employees came by my house on her way IN A RUSH and said I NEEDED TO SIGN A FORMAL AGREMENT and she only had the second page of it and was in a hurry and the bulb outside my door was burned out and if I didn't sign it before the office "officially" closed that evening they would file the offical summons and complaint she claimed she was doing me a favor by running back to the office to turn it in on her way home" so I naively signed something I later foud out was drafted and altered by their attorney).

Needless to say they had their default judgment and writ of restitution allowing them another $3700 on top of what I had just paid - nice SCAM HUH' Well I spent the next two weeks in court trying to vacate the judgment and get a stay on writ of restitution and clear my name (I had to file over 40 Exhibits, a Notice of Appearnace, and Answer and Motion Denying Rent Owed, Motion to Vacate and Order to Show Cause, and HAD ZERO FUNDS to pay an attorney (I had even gotten my power shut off for two days while making the $3400 in rent payments in less than 6 weeks). I did win my stay and had all the receipts for the money orders but since it was an ex parte commissioner ( a lawyer not a real judge) and she was on a first name and knew his daily schedule and everything else personal about their attorney who practices in ANOTHER county. I knew she would ignore all the evidence, all the RCWS for landlord tenant law.

And since the landlord and attorney over 2 days in court could STILL NOT PROVIDE AND TYPE an ITEMIZATION OF PAYMENTS RECIEVED AND MONEY OWED let alone come up with the same amounts payments and dates over 2 days in front of witnesses, the landlord finally implied that the reciepts to the money orders were not enough proof. They had money order themselves receipts with their name on it - in addition to the cash register receipts and the ability to call and 800 number and verify of the money order had been cashed and on what date. The judge ruled that BECAUSE THEY COULD NOT KEEP AN ACCOUNTING I WOULD HAVE TO PAY $12 for EACH MONEY ORDER (8 total) and submit it to Western Union for copies of the cashed money orders which can take up to 90 days...

So they got my $3500 (I did get the judgment amended and pending arrival of the proof in a couple months) and less than 2 hours after we left the court house (every day from 9 -3 for 8 days from the night I learned that paying off all the rent was a scam and the minute I did I would be defualted and kicked out on the street 7 days later) the sherrif knocked on my door (I had been packing and moving during the evening and had not worked in almost two weeks due to this crisis.

I asked to gather my personal things like keys separtated my purse-pda-cell phone etc but they refused and sent me outside and I asked where the landlord would store the rest of my things for me to come get as provided in the WA state landlord tenant act - they laughed and said "Oh we are putting it out on the street" AND THEY DID IN THE RAIN, I also had gotten (after my docs donated half the cost to me and I had finished payments off just 3 weeks earlier on a $20k ortho surgi-bed (I have severe back injuries and a heart condition) they they DESTROYED (I have over $25k in computer equipment for my business) they moved me outside and proceeded to have 7 or 8 workers (late teens) proceed in to my home (my furniture was all brand new bought in Sept for $8k - they only things I hadn't packed were my clothes in my closet and bathroon make-up- stuff as well as disasemble my brand new four poster bed.) I WOULD ESTIMATE THE DAMAGE DUE TO RAIN AND HAVING A BUNCH OF TEENS THROWING IT DOWN THE STAIRS as well as my personal glasssware - electrical equipment etc that were in boxes and packed BUT NOT TAPED - DUMPED OUT IN TO GARBAGE BAGS and THEY KEPT the 12 BRAND NEW MOVING BOXES I HADN'T PACKED BUT HAD ASSEMBLEMD INSTEAD.... They did about $26k in damage to my REMAINING PROPERTY (remember everything was new) which was actually very little. I had already disaembled the glass tables, nighstands, for the spare room, living room, the two huge new mutli-livel desks it took my and friend 3 days to assemble, etc.....

Fortunately I dug through the stuff and found my cell phone and called my mom who went and got a u-haul and brought my son to help load the soaking funriture and valuables and take it to the storage unit a mile away and I had to move in to my parents for the first time in 16 years) THEY WIPED ME OUT. Here's the kicker the HAD WITH-HELD 3 packages all priority mailed to me on 3/3 (I moved out on the 16th and checked for the packages every day) and when I filed my change of address on the way to the storage that same day I FILED A TRACE AND COMPLAINT ON THE PACKAGES - all three (one from LA one from NY and one from WI all sent priority mailed on 3/3) arrived at my parents less than 5 days later.. I HAD RECIEVED PORBABLY 40 Priority mail packages (I am an e-bay purchaser and reseller) in 7 months and NOT ONE HAD TAKEN MORE THAN 4 days PRIOR TO IT. All the packages had the familiar black felt writing of my unit number (landlord does it to easily spoit in cabinet).

ANYWAY the ONLY OTHER MAIL I have GOTTEN (not my phone or utility or checking or credit bills or regular mail which stopped the day I filed an answer to their judgment) WAS A STATEMENT OF DAMAGES FROM CANYON SPRINGS WHICH ARRIVED THE SAME DAY THE PACKAGES DID (nothing since either to date) STATING I NOW OWED THEM AN ADDITIONAL $5800 AND IT DID NOT INCLUDE THE ATTORNEYS FINAL FEES!

So lets see deposits were around $500, Sept, Oct. Nov Rents totaling $3500 and then the $3500 I paid PLUS THE $1500 they claim they never recieved payments of (they also claimed they couldn't take my personal check and would return it, but cashed it anyway after I got a money order the same day) and now WANT $5800 PLUS ATTORNEYS FEES' They tried to attach more back rents on to the damage checklist I NEVER SIGNED OR TURNED IN AND was even there long enough or home enough to do any damage - lol) .

SIX MONTHS AT CANYON SPRINGS COST ME $14,300 potentially' I lost $2000 in lost revenue from contracts I was working on and had to drop to go to court and then move and suffered $25k in property damage.

AM I SUING THE ---- OUT OF THEM''' HELL YES...

I am filing for a real judge to vacate the judment and then appealing with a counter-suit.... The appealate courts are great - ALL THEY DO IS REVIEW EVIDENCE AND MOTIONS AND CASE LAW and weigh their decision and my paperwork was more professionally done than their landlords attorney (coming from a passerby judge who spoke with me)..

I used to work for the state Bar Association and have filed a complaint against their attorney (he though I asked for his card cos I was sucking up like a dumb blonde to him and all I really wanted his real name) for unethical behavior and with-holding information to the court...

Oh a couple more things.... YES THERE ARE COPS ALL OVER THERE AMOST EVERY NIGHT on street corners doing searches. I know 4 people that had their cars broken in to there and apparently there was a couple living there that CPS just removed the kids that were kept locked in closets for months....

REAL NICE NEIGHBORHOOD..... BTW don't pay for the application fee THEY DONT DO A CREDIT CHECK - they only verify your last residence....
