Threats from awful HOA for $25,000 special assessment

Waters Edge is a great neighborhood, but beneath it all is a wretched HOA, corrupt, mean spirited, and rotten to the core. They threatened the residents with an insane $25,000 special assessment per unit (about 1/4 the value of the homes) to reskin these places in the last annual meeting. There is a lot of tension in the area right now because of this. I would sell mine if I could, but there is no way that will happen with the lawsuit and the threat of a large assessment.

The president of the board just resigned - I have suspicion of serious corruption. There hasn't been a legitimate election in a while... The bylaws are only followed when the board feels it is in their best interest.

Oh, there is a huge lawsuit in progress too...

Parking has become restricted because of our fascist board members. Park in an open lot' Expect a huge sticker on your drivers side window that takes a razor blade and goobegone to remove. Nice suprise when you are on they way to work... A note under the wiper would suffice (they can write down offenders plate#...)

Oh, and there have been two murders here since 2005. And a few sex offenders- the HOA tends to protect them and hide it from residents.

Oh, and our gardener is an overpaid (about 60k/year) illegal alien that was renting the former president of the HOA's unit... conflict of interest. Now Way!

I was so happy when I moved in- there was no HOA at the time. Things have gone bad quickly. I want to leave, but it is probably not going to happen.

Did the lawsuit appeal die? I thought we were still in round 3. I knew that we had won the first round against the original slum lord who is responsible for not maintaining this place- then we lost when we joined forces with the previous owners (because we could not get enough$$ from them) and Waters Edge went after the insurance company. I was under the impression that we were in round 3- appealing the second loss, at least that is what that slimebag attorney said in our last meeting. I was thinking that is why the assessment has not happened yet. Some prospect of a payout may still be there, but after attorney's fees we would still be left with a big chunk of the bill. A friend has speculated that the board in in collusion with an outside group... the assessment would cause a massive amount of foreclosures (the assessment balances would be put on the owners that could afford it and are willing to pay until that balance grows too large... once the per unit assessment becomes unbearable, all the units will be in foreclosure and would leave it open to purchase by a commercial entity. Remember the rumors of walmart? why not make this whole area a commercial zone? bulldoze all these homes so someone can build another store/ stripmall or business park. The details surrounding the board are scary... why no elections? each person that leaves is replaced by another person who is friendly to the current board's agenda? Why not hold a special election? Why do we have no say? I hate the annual meeting because nothing is accomplished, but there is always the looming threat of an assessment vote or a vote to kill the super majority vote.... I really regret moving in to this place- it was a good deal at the time, but once we got the HOA involved, things became unpleasant and there is always the stress of a possible humongous assessment....

My son sent me the URL to this post and asked me if I wrote it. I could have! I didn't know some of these things; that the grounds keeper was an illegal (too bad, I really like him!) or what his salary was (but you'll have to admit that he does a splendid job of keeping the grounds looking sharp). But this is a pretty accurate reflection of the hell that is Waters Edge. The Fascist board does manipulate the rules to suit itself. I saw someone's dog doing its business on the lawn. Another board member happened to be with me and said he'd go over and nab the owner (the intent was to fine them) but when they discovered it was another board member there was of course no fine assessed. This post must have been written awhile back, b/c the law suit failed and we are all sitting here waiting for some horrific assessment. I understand that when this place changed hands shortly after I got there, that the slush fund of approximately 30k earmarked for maintenance mysteriously "disappeared". I truly don't feel it was the work of the previous managers, but no one, to my knowledge, spearheaded any kind of exhaustive investigation like one would normally expect under these circumstances. In terms of being unhappy being there, I haven't talked to anybody (other than that one board member) that was satisfied with living there. Everyone else you talk to is disgruntled and wishes they could move. *I* wish I could move! I began to hate it there soon after moving in 5 years ago. (Well, as soon as the other managers left and "The Board" began to take things over. They also like to leave posts on our doors scolding us for various perceived infractions. These are always signed "The Board". Maybe some day the economy will improve and I can get out of there. There's already been a mass exodus, and for sale signs have gone up all over the complex; like rats leaving a sinking ship. Moving in there is definitely one mistake I have regretted (and paid for!) time and time again.

A footnote to my post (11/23/08) Victor our groundskeeper is *not* an illegal. And I do believe the person who responded to my post is correct in that negotiations are continuing are we are in round 3 (if that's the correct count). I had an opportunity to watch KOMO channel 4 from Seattle recently and someone did an editorial on condominiums and highlighted all the red flags; condo boards, issues with common areas, special assessments etc. and said to beware of all the issues before buying into a condominium. Check out the board, talk to owners to find out what the issues are etc. Good advice, I obvious was not a saavy buyer... Well, I guess it could be worse, sometimes I wonder how, but I'm prayerfully optimistic that this will all come out in the wash. Oh, and re; pedophiles at Waters Edge, don't believe everything you hear. There's usually more to the story (any story) than meets the eye.

Since elections - things seem to have leveled out a bit. The old board was so terrible and so negative about everything. The gardener - illegal or not seems to do a good job, but he is probably overpaid looking at the financials... especially if our area is going to be turned into a construction site at some point in the near future... what does it matter if the grounds look good if everything else looks like hell? There are child molesters in the neighborhood. One's name is Lloyd McCullough and he made his young(8 years old or so) step-daughter jerk him off. I read the court documents. So keep your kids away from that guy... He lives up on the top of the hill in an end unit - he is a renter. I also saw him get violent with a neighbor and the cops showed up later in the same day. That was a long time ago though... I hope all this lawsuit stuff ends soon... I just want to get out and get into a nicer place. This was only meant to be a short term home for me. I could have taken other opportunities, but this place has been such a hassle it has made it difficult to move somewhere else without taking a big loss. There are so many things that could be done to fix the place up without the high cost. That Architect that was hired by the last board was absolute scum, he was trying to get the cost of repairs up to 45k per unit, when some people bought their smaller units for 60k... who would stick around and pay that? Most would just foreclose and leave if they couldn't sell... One of the biggest problems with Waters Edge is that people who moved in when they were converted were duped - the conditions were no fully disclosed - or there were outright lies about the structural repairs needed. It is unfortunate, but I have hopes that our new board has the best interests at heart. They have a reasonable building fund going, instead of counting on the lawsuit to fix the buildings.
