Oak Creek Apartments Manager

Unfortunately these residents have choosen a public avenue to air their dispute, hoping that will hinder future residents from renting. But the truth is they had a formal move-out inspection and every item that they were charged for was pointed out to them and noted on the move-out inspection, which they signed. They lived in the apt for one year, and had brand new carpet when they moved in. The carpet was permanently stained with "red wine stains" and "coffee stains" through out the apt. Which his wife told me she and the kids had spilled. We did have the carpet professionally cleaned before replacing it, but those stains were permanent and we could not rerent the apartment in that condition. They were given credit on the carpet bill for the 12 months that they lived there, so they did not have to pay the entire bill. Just the remaining life the carpet should have had. Also the apartment needed a thorough cleaning, as was noted on their move-out inspection. Lastly, the new stove top had the paint scraped all the way down to the metal and was completely damaged. They must have tried cleaning it with a screw driver or other metal tool. This is not normal wear & tear! We are fair and reasonable and take pride in our community. We also stand completely behind our charges to these residents for the extraordinary damages they caused to the apartment. Most people when they leave take great care to leave the apartment in a good, clean condition. This was certainly not the case with these residents.

Oak Creek Apartments Manager

This resident is only partial right... Don't sign a lease if you do not plan on fulfilling it. A lease is a contract, a legal, binding contract. However, she is incorrect in stating that we have a $3,500 penalty or that we may have misresprented questions about our policies. She is also incorrect in stating that we were told when they moved in that they were planning on buying a house, or that they may need to break their lease early. When every resident moves in, we go over the entire lease, paragraph by paragraph with them, explaining it completely. A lease is a binding contract. The landlord and the tenant are both bound by this contract. You, the resident, agree to live in the unit for the entire lease term and agree to pay a specific amount of rent for that term. We, the landlord, agree to maintain the unit in a good, habitable condition and agree to keep your rent fixed for that lease term. This resident agreed to sign a 10-month lease when they moved in and they received a REDUCED RENT for that lease term. They had the option of signing a 6-month lease for $50 per month more. Had they really been thinking of buying a house when they moved in, they surely would have opted for the shorter term lease. It amazes me that residents would be so one-sided when it comes to wanting to terminate the contract, just because it's convenient for them. Turnover costs the landlord a lot of money, which is why we give residents a reduced rate for longer term leases. If rates happen to go up during the lease term, the landlord cannot try to "renegotiate" the rent. This is a contract that we are both locked into. Should a resident need to break a lease, California state law requires a resident to pay the landlord the cost incurred to try to re-rent the apartment and pay for any lost rent. We never know how long it will take to re-rent an apt, nor can we give an amount for those damages in advance. We do have a "cap" on our damages in the amount of $3,500. This does not mean that a resident will have to pay that as a penalty, it just means that the amount of rent and advertising costs could not exceed this amount. When a resident gives notice they will be breaking their lease early, we immediately put the unit back on the market and try to get it re-rented as quickly as possible, to minimize any costs the resident will have to pay. In some cases, the apartment gets re-rented within a week or two, as was the case this month. Someone broke a lease and we had the unit re-rented within 14 days. The resident(s) who wrote this "rating" are actually a really nice couple, however, I am really disappointed that they could give an inaccurate account of our policies and what they were told. I don't think that they would disagree that they have always been treated with respect, courtesy and professionalism. Every problem that they reported was immediately addressed and resolved. They even wrote us a note on May 2, 2007 stating "We really appreciate how well the complex is maintained". This was only one month before they wrote this "rating". I can understand that they are disappointed that we didn't have any quick or easy answers for them to let them out of their lease. I can also understand that excitement of wanting to buy your first house. I know that they are expecting their first baby and I appreciate that this resident later apoligized for her emotional outburst when discussing the possiblity of terminating their lease early. "Hormones", she explained. Clearly this was written about the same time. Please don't sign a lease unless you plan on fulfilling it. We'll live up to our end of the bargain... Will you?

Oak Creek Apartments Manager

This resident has incorrectly stated the facts about their security deposit deductions. The facts are: 1) We have apartments that are completely remodeled with new appliances, flooring, sinks, faucets, countertops, interior doors, baseboard molding, and lighting. This couple rented a non-remodeled unit for a DISCOUNTED PRICE. 2) They signed a move-in inspection (which they filled out themselves) that stated the apartment was in "GOOD", "CLEAN" condition upon move-in, with a few minor exceptions for normal wear and tear ie: "stove-chip in paint"; "bedroom door - knob loose"... 3) When they gave notice to vacate, they were provided a cleaning check list which spells out everything to clean in order to avoid any charges at move-out. 4) They did NOT leave the apartment clean. His wife completed and signed a move-out inspection with us, noting that nearly all the items in the apartment were "DIRTY", "DUSTY" or "NEEDED TOUCH UP CLEANING". 5) They did have a BRAND NEW CARPET when they moved in. However shortly after moving in they reported fleas. Although we have never had this problem before, it is possible that this came from a previous resident's cat. However, immediately after reporting fleas, the apartment was treated and the problem immediately resolved.

Oak Creek Apartments Manager

I'm not the manager he's referring to, however... The windows and screens are washed prior to move-in, which is part of standard housekeeping. And the "spill" on the carpet he is referring to was the living room carpet SATURATED IN CAT URINE! Sorry, but cat urine on the carpet does not constitute "normal wear and tear". The carpet had to be replaced.
