In Sept. I contacted Briarwood II Apts. in Normal, IL. I was moving from out-of-state. Asst. Mgr. (--------------) said apt would be ready for my move-in in October. In early September I was asked for a $30 application fee and approx. 09/21/11 I was told I had to pay a security deposit ($300, 1st months rent $770) PRIOR to October, when I'd arrive in Illinois. Ms. Hall said I must pay the sec. dep./rent BEFORE I move on Oct. 6th. She said I "have to mail the $ before she can process the paperwork. I thought it was odd since I was moving from out of state. On Oct. 3rd Asst. Mgr. told me apt was move-in ready, carpets were going in that day. That was the 3rd time she told me carpets were going in. I contacted her on 10/5/11 and said I would be picking up keys possibly on 10/7/11 but if I wasn't there by 5pm I would pick them up on Saturday 10/8/11. On Saturday, I met with Asst. Mgr at office. She said she could not give me key until after I signed the rental agreement in original ink. Then afterward she would show me the apt. When we arrived, the apt was NOT ready. Carpet was installed but stove was not usable (rusty, filthy). Walls/doors not painted. Water damage and mold in each bathroom. Wall trimming throughout apt. and refrigerator was "chewed" by a pit bull (per comments by Asst. Mgr.) that lived with former tenant. I discussed what the information she had given me prior to arrival and the condition unlivable. Asst. Mgr. said I'd have to speak with Mgr. on Monday. She said she was also on her way out to a function out of town and couldn't contact the Mgr. I spent the night there Saturday night only. On Monday, I contacted Asst. Mgr. expressed my concerns and their lying about the apt. being ready. I explained that the photos of the apts online were NOT what I saw when I arrived nor was the condition that she said it would be in. She put me in touch with MGR (-------). I met with Mgr. that day and returned my keys to the apt. She called maintenance to go with us to apt. She did a "walk through" and noted the many things that needed to be fixed or replaced. Cabinet doors through ALL kitchen were "hanging" on their hinges as well. I tried to discuss what was told to me before I moved in. Mgr. "hushed" me more than once and said she "didn't want to talk in front of the maintenance guys". After she did a walk though I told her I could not live there. The apt was NOT livable and the environment was not good. Residents were running up and down the stairs all night and loud party music as well. I explained that the apartment was NOT in any way even close to what was depicted and advertised online on their website or what I had been told by the Asst. Mgr. I went to her office and asked for my money back. She said they were not going to give me my money and that I "HAD TO" give her a chance to fix the problems with the apt. I said I was going to find another residence because they were not honest in their business dealings and lied to me about the apartment being ready. I also told her the asst. Mgr., when seeing the apt. for the first time, said, "I'm so sorry. It was supposed to have been ready. I thought it was going to be ready." She also took out her cell phone camera and took pictures of the stove and told me, "I hope she changes it out for you. This isn't safe to use." When I demanded my $ back, Mgr. said she was "doing me a favor" since I am suppose to give a 60-day notice of move out. She said I am liable for 2 more months rent. Then she told me if she can rent the apt. by the 31st of October, then she would NOT charge me an additional 2 months rent for breaking my lease. I told her I wasn't breaking my lease and that THEY broke the agreement. She said that I cannot call or tell her supervisor OR I will be liable for the early lease termination of 2 months PLUS 1 years lease. However, in the same conversation she told me, I m actually shocked at the condition. This isn t how we turn apartments. She also apologized and said they d had 15 apartments to turn . She also added that she was going to write my move-out date as October 31st, instead of that day which was Monday, October 10, the day I returned the keys and this conversation took place. She said it was policy. Before I left she reminded me to not call her supervisor and say anything or she will enter this as an early lease termination. When I called back twice to speak with the Asst. Mgr., --------------, (that originally communicated with me on ALL dealings) she said she was instructed to pass all my calls to the Mgr. but only took a message. In addition to Briarwood's Fraudulent dealings with the apartment, during the conversation with the Mgr. -------, we discussed the income guidelines. She said she would not report my income if I went over the guidelines set by the Affordable Housing Program - a Government Program. She went on to say, "We have residents who make $70,000 and I don't report it." Anybody contemplating living here should beware.
