After living here for over 28 months and paying the considerable rent very promptly, I have requested to get out of my lease 2 months early. Living here during the construction of their second tower has been just terrible. 6 months of pounding, followed by construction noise starting promptly at 7AM. Since I work nights this has been unbearable. The amenities space is basically now is a sandbagged construction zone and inaccessible. The garage is filled with construction debris and dust and multiple cement trucks block the entrance to the building daily. Although I requested early departure from: ------------------ Assistant General Manager ------- Her response was basically, this: 2. As you know, Jersey City is still developing and construction activity is inevitable causing unforeseen traffic delays and overall noise pollution. I understand this may be an inconvenience during early morning hours however, per city ordinance construction may occur as early as 7am. And this: Please note the following is required should you wish to terminate your lease early: - Executed Notice to Vacate Form including a minimum of 60 day notice (form is attached) - Buy-out Fee: $10,560.00 ( Due within 3 days of notice) All to leave 2 months early with ample notice... Jersey Sate law clearly indicates that landlords must advertise and re-rent vacant apartments aggressively to mitigate damages. ------- management pretends to show concern and care, but in the end, highlight the construction addendum on the lease we were forced to sign. All they care about is the bottom line, not keeping their tenants happy.
