Summary: run screaming. Do NOT give them a deposit during lease negotiations. When you have the paper lease in front of you ready to sign, make sure you look for any clause about an Air Conditioner agreement and don't listen to any BS about how you can ignore it. If you haven't run away yet, you should now. They said electricity was included and we could use whatever A/C we wanted at no extra charge. I found a review on this site from someone who said they weren't allowed to use any A/C but one the building provided, and it always broke and the building was very slow to fix it. It's an old review so I gave them the benefit of the doubt and asked the agent about it. He said that's total news to him, and that we can use whatever we want at no extra charge, so we moved forward. About a week later, with the paper copy of the lease in front of me, I notice a clause about having to sign a separate A/C agreement, and that you can't install an A/C without permission, and that it may cost extra. Outrageous, a complete 180 from what the agent promised. Of course the separate A/C agreement wasn't included in the package either. When I questioned them about it I got an email from the management company that said just disregard it, BUT DON'T CROSS ANYTHING OUT. Of course, the lease also says that written communication not included in the lease isn't binding, so that's no assurance at all. We walked away because this is beyond shady. If they weren't planning to do something nasty they would just write the conditions into the lease instead of referencing a separate Air Conditioner document. Now they're reaching out to me about how they made a special arrangement with the landlord (who, by the way, is on the NYC public advocate's list as one of the worst landlords in NYC) to remove this clause completely. Why doesn't everyone get this benefit? They're playing so dumb here, like this couldn't have possibly ever come up before, it's sickening. Trust your gut and run, don't walk away.
